Personal & Substitute Service
Personal service is a core procedural requirement in many civil, criminal, and family law matters. Our licensed process servers regularly effect personal service of Statements of Claim, Originating Process, Tribunal Notices, Family Law Applications, and enforcement documentation.
Where personal service cannot be achieved after reasonable and properly documented attempts, we proceed with substitute service in strict compliance with the Uniform Civil Procedure Rules 2005 (NSW). This may involve service on another person at the address, service by post, or other court approved methods.
Key elements of our approach include:
- Conducting service attempts promptly and at varied times to increase the likelihood of successful personal service.
- Maintaining detailed service records, including dates, times, addresses, and notes on any interactions or observations.
- Preparing precise affidavits of service that reflect the exact manner in which the document was served.
- Communicating clearly with the instructing solicitor or client on the outcome of each attempt.
Our structured, evidence-based approach ensures that if service is later challenged, your affidavit record is complete, accurate, and court ready.
